Montgomery County Circuit Judge David A. Boynton said the Maryland Board of Chiropractic and Massage Therapy Examiners went too far in issuing a cease and desist order in February 2008 preventing H. Mercedes Clemens from massaging horses. The board s authority is limited to the practice of human massages and it cannot regulate animal massage, Boynton added. Clemens said she felt  completely vindicated by Boynton s ruling. <BR> It s been a long road, but the destination was worth it, she added. Clemens attorney Paul Sherman called the decision  a total vindication of Mercedes right to earn a living as an equine masseuse.  Now she can go forward confident that [the board] will not come after her again, Sherman said.  This is a total victory for economic liberty. The board s attorney, Grant Gerber, said the board will  abide by the ruling but does retain the right to appeal the decision. Regulatory authority <BR>During the 25-minute hearing Thursday morning, attorneys for the board and Clemens squared off over the agency s authority to prohibit licensed massage therapists to ply their trade on horses. Boynton questioned Gerber on the board s belief that it could regulate animal massages under its statutory authority to oversee personal massage therapy.  How can you massage human parts on a horse? Boynton asked. In response, Gerber said the board does not regulate horse massage. Rather, the board, in its ban, is regulating the activities of its licensed massage therapists, which is within its statutory authority, said Gerber.  The board may very well have control of what its licensees can do with their license, said Gerber, an assistant Maryland attorney general.  The board has no interest in regulating animal massage. It does have an interest in regulating its licensees. <BR>Sherman countered that the board has  no authority over animal massage whatsoever. Sherman is with the Institute for Justice, an Arlington, Va.-based group that represents business owners challenging what it believes to be excessive government regulations that stifle entrepreneurship. Gerber also argued that Clemens challenge to the board was moot because the agency rescinded the cease and desist order in June. However, Sherman told Boynton that the lifting of the cease and desist order had no practical effect because the board had not rescinded what it believed to be its authority to bar its licensees from massaging horses.
